1. Acceptance of Terms

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and MY TOUR CAB PRIVATE LIMITED (“MyTourCab”, “we”, “us”, “our”), governing your access to and use of the website mytourcab.com and related mobile applications (collectively, the “Platform”).

By registering an account, making a booking, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately cease use of the Platform.

2. Nature of Service

MyTourCab is an online marketplace and booking intermediary that curates fixed-price cab itineraries and connects travellers with verified independent cab operators (“Vendors”) across India. We are not a cab operator, transport company, or travel agent.

The actual transportation service is provided by the assigned Vendor. MyTourCab facilitates the booking, payment, and co-ordination — we do not directly control the Vendor's operations, fleet, or staff.

3. Eligibility

• You must be at least 18 years of age to create an account or make a booking.
• You must have the legal capacity to enter into contracts under the Indian Contract Act, 1872.
• If you are booking on behalf of a group, you represent and warrant that you have authority to bind all members of the group to these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate, current, and complete information at registration and keep it updated.
• You are liable for all activity that occurs under your account.
• You must notify us immediately at [email protected] if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Bookings & Payments

5.1 Booking confirmation

A booking is confirmed only upon successful payment of the token amount (25% of the total trip price). Until payment is received, no reservation is guaranteed. A booking confirmation email will be sent to your registered email address.

5.2 Balance payment

The remaining balance (75% of the total trip price) is due before the trip departs. Failure to pay the balance by the due date may result in automatic cancellation without refund of the token amount.

5.3 Pricing

• All prices displayed are per vehicle, not per person.
• Prices are in Indian Rupees (INR) and inclusive of applicable GST unless otherwise stated.
• Prices do not include accommodation, meals, entry fees, or any service not explicitly listed in the itinerary inclusions.
• In the event of a manifest pricing error, we will contact you and offer the option to proceed at the correct price or receive a full refund.

5.4 Payment processing

All payments are processed by Razorpay. By making a payment, you also agree to Razorpay's terms of service. MyTourCab does not store your full card details.

6. Cancellations & Refunds

Please refer to our dedicated Cancellation Policy and Refund Policy for full details. In summary:

• More than 4 days before departure: Full token refund, less gateway charges (free cancellation).
• 4 days or less before departure: 85% of token refunded; 15% cancellation fee retained.
• MyTourCab/Vendor cancellation: Full refund of all amounts paid.
• No-show: No refund.

7. User Obligations

You agree to:

• Provide accurate passenger count, luggage information, and pickup details at the time of booking.
• Ensure all passengers are present at the confirmed pickup location at the scheduled time.
• Treat the assigned driver and vehicle with respect.
• Not carry prohibited items (weapons, inflammable materials, illegal substances) in the vehicle.
• Not use the Platform to submit fraudulent or fictitious bookings.
• Not attempt to circumvent the Platform by dealing directly with Vendors to avoid our service fees.
• Comply with all applicable laws during travel, including road safety regulations.

Any damage to the vehicle caused by passengers will be the financial responsibility of the lead booker.

8. Vendor Responsibilities

Vendors are independent contractors and not employees or agents of MyTourCab. Vendors are responsible for maintaining valid permits, insurance, and licences; ensuring vehicles are clean and roadworthy; arriving on time; and following the agreed itinerary route.

MyTourCab screens and verifies Vendors before onboarding but does not guarantee the conduct or performance of any Vendor. Issues with Vendors should be reported to our support team immediately.

9. Limitation of Liability

To the maximum extent permitted under applicable Indian law:

• MyTourCab's total liability shall not exceed the total amount paid by you for that specific booking.
• We are not liable for indirect, consequential, or punitive damages, including loss of profit, loss of data, or loss of enjoyment.
• We are not liable for delays or cancellations caused by events outside our control (weather, natural disasters, road closures, government orders).
• We are not liable for personal injury, death, or property damage occurring during the trip.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under the Consumer Protection Act, 2019 or other mandatory law.

10. Intellectual Property

All content on the Platform — including itinerary descriptions, pricing, photographs, graphics, logos, and software — is owned by or licensed to MyTourCab and is protected under the Copyright Act, 1957.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

11. Privacy

Your use of the Platform is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your data as described in the Privacy Policy.

12. Indemnification

You agree to indemnify, defend, and hold harmless MyTourCab and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your violation of these Terms, your violation of any applicable law, any false or misleading information provided by you, or damage caused by you or your group during a booked trip.

13. Termination

We reserve the right to suspend or permanently terminate your account and access to the Platform, with or without notice, if we reasonably believe that you have violated these Terms, provided false registration information, engaged in fraudulent activity, or abused, harassed, or threatened our staff, drivers, or Vendors.

14. Changes to Terms

We may revise these Terms at any time. When material changes are made, we will update the “Last updated” date, notify registered users by email at least 7 days before changes take effect, and display a notice on the Platform. Continued use of the Platform after the effective date constitutes your acceptance of the changes.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of India, including the IT Act, 2000, the Consumer Protection Act, 2019, and the Indian Contract Act, 1872. Any dispute shall be subject to the exclusive jurisdiction of the courts of Kerala, India.

16. Grievance Officer

In accordance with the Information Technology Act, 2000, we have designated a Grievance Officer to address complaints arising from the use of the Platform.
